Frequently Asked Questions

SO WHAT'S YOUR QUESTION?

Many of your questions can be answered by taking a look below.  Take a quick look and don't forget to check back with us periodically for updates.

What information is available on a criminal records search?

If records are found, they will range from felonies, misdemeanors, petty offenses, traffic offenses, and parking tickets.  You can find anything from shoplifting to credit card fraud and aggravated assault.

How far back does a background check go?

The length of the search depends on the type of record search being ordered.  However, county level criminal record searches go back seven years.  Repositories, such as statewide criminal record searches and the National Criminal Record Index may go back further and other searches, such as address history or professional license searches go back as far as the data is available.

What information is available on a divorce record?

The information available will vary from jurisdiction to jurisdiction but many records will include the party names, such as the petitioner and respondent, the date the case was filed, the case status, and any available judgment information.

What if the information returned a criminal records search is inaccurate?

If you believe the report you have received is incorrect, please contact our customer service team at support@checkmycriminal.com.  We will address any inaccuracies on our internal database but we are not responsible for inaccuracies held by our sources.  If you believe a court is misrepresenting your criminal record history, you should consult with a licensed and qualified attorney.

Do I have to obtain a waiver to conduct a background check on someone other than myself?

Nope!  The information we are providing is strictly public record information and written authorization of the subject is not required.  Our services are not to be used for any purpose requiring authorization. CheckMyCriminal is not a Consumer Reporting Agency as defined by the Fair Credit Reporting Act and the information made available may not be used for employment, insurance, tenant screening, consumer credit, or for any reason that requires FCRA compliance.

Can my criminal records be seen in other states?

If you have a criminal record, this information is most likely public unless the information has been sealed or expunged.  It can be accessed by anyone regardless of their residence.  However, the information on this website is not legal advice, expressed or implied.  The materials provided are for informational and educational purposes only.  If you believe your criminal history should not be accessible, consult with a qualified and licensed attorney.

Why is it a good idea to conduct a public record search on people I may come into contact with?

There are a lot of valid reasons.  You're trying to locate an old friend.  You've been set up on a date and you don't want to put yourself in a vulnerable position with a complete stranger.  You want to know what information exactly is available on that marijuana charge from years ago.  Honestly, you're just nosy about your new neighbors.  Still not sure?  Take a look at our Do's and Dont's of using CheckMyCriminal for more information.

What information does a vital records search include?

The term vital records refers to birth and death records as well as marriage and divorce records.  We are only able to provide information that is publicly available and this may vary from state to state.

How long does a criminal background check take to return results?

We are not an "instant" people search trying to pass off information barely better than what you would find on a standard search engine.  Depending on the type of criminal record search being ordered, the processing time takes from 1 to 72 hours.

What records are available on this website?

Take a look at our product list to see exactly what's available and for additional information about each product offered!

How much does each type of search cost?

This information can also be found on our product list.  Just click here!

How accurate is this background check?

No one can claim to be 100% accurate, complete, or up to date.  Our reports rely on both primary and secondary sources depending on the product being ordered.  However, if you are concerned with someone's criminal history, we recommend a county-level criminal record search for when you need an in-depth report on someone's possible criminal record history.

What information is required to be provided in order to conduct a criminal records search?

In order to conduct a county level, statewide level, or National Criminal Record Index search, we require the subject's name and date of birth.  This way, you will find the information you are actually looking for and not sifting through hundreds of results belonging to other people.

How do I receive results?

Results will be emailed to you in a password protected PDF.  The password will be sent separately from the results.

Are juvenile records available?

If a juvenile is tried in an adult criminal court, court records are open to the public.  However, juvenile court proceedings are usually closed to the public and will not be reported.

Are expunged/sealed records available?

Nothing is absolute.  Expunged/sealed records are not public information.  However, if the court fails to redact the information, it may still be available through public resources.  If you believe your record should be sealed or expunged, please contact a licensed and qualified attorney to assist you in this matter.

Can I use the results obtained from this website as a suitable background check in order to hire a new employee?

Absolutely not!  The information provided in our reports is public record, but there are strict guidelines on how this information may be used.  CheckMyCriminal.com is not a consumer reporting agency, as defined by the Fair Credit Reporting Act, and use of this information for employment, insurance, tenant screening, consumer credit, or any other reason governed by the FCRA, is strictly prohibited.  Misuse of our reports will not be tolerated and will result in the termination of services.

What forms of payment are accepted?

Visa, Mastercard, and American Express.

How many requests can I submit at one time?

We offer single records checks and packages but right now our system only supports ordering one record search or package at a time.  However, you can make as many transactions as you like.
